2024 HOPE RAFFLE
OFFICIAL RULES AND REGULATIONS

The 2024 Hope Raffle ("Raffle") is being conducted by Hope School Foundation, a not-for-profit charitable organization. The Raffle is being conducted pursuant to the Illinois Raffles and Poker Runs Act, 230 ILCS 15/0.01 et seq., and the Sangamon County Code, Chapter 5.18 Raffles and Poker Runs, to raise funds for ongoing charitable purposes. The 2024 Hope Raffle Official Rules and Regulations (the "Official Rules") are set forth below. By purchasing a Raffle ticket (a "Ticket"), the purchaser acknowledges that he or she is aware of, and agrees to be bound by, these Official Rules and Hope's interpretation of any such Official Rules. Hope shall be responsible for interpreting and applying the Official Rules. Hope's interpretation and application of such rules shall be final.

Eligibility

Any individual who is 18 years of age or older and an Illinois or Missouri resident at the time of the purchase of the Ticket is eligible to enter the Raffle. Hope employees, officers, members of its Board of Directors and their respective spouses and children living in the same household are excluded from participating in the Raffle and are ineligible to win a prize. All federal, state, and local laws and regulations apply. The Raffle is void where prohibited by law. Not open to residents of California.

Tickets

Raffle Tickets are one for $50, 3-packs for $125, and 6-packs for $200.

50/50 Add-On Tickets are one for $20, 3-packs for $50, and 6-packs for $75.

Between 6/10/2024 and 6/21/2024, any multi-pack order received that uses the promo code HOPE10 during an order will receive a 4-pack of Raffle Tickets for $125 or an 8-pack of Raffle Tickets for $200.

Multi-packs using promo codes must be purchased during the same order, using one method of payment, using the same name on each ticket and the same mailing address for each eligible ticket. Orders that do not use the aforementioned promo codes during the aforementioned dates, or orders that are received before or after the aforementioned dates are not eligible for a 4-pack or 8-pack as noted above.

Only one Eligible Ticket Purchaser (as defined below in the "Eligibility" section of these Rules) may purchase a ticket. This means, (a) one name per ticket and (b) one purchaser per transaction. An Eligible Ticket Purchaser may designate another person a Ticket Holder. If a ticket names more than one person as a Ticket Holder and that ticket is a winning ticket, then Hope will (a) deem the person named first on the ticket as the Ticket Holder, (b) declare the first person named on the ticket as the winner, and (c) award the prize to the first person named on the ticket. In such case, the division of the prize shall be the sole responsibility of the first person named on the ticket. Once Hope awards the prize to the first person named on a ticket, Hope will have no further duties or obligations with respect to the division of the prize and all persons named on a ticket as Ticket Holders release Hope from all claims relating to the award of the prize or its division among other persons on a ticket named as Ticket Holders.

How to Purchase Tickets

All entries must include payment by credit card. Hope reserves the right to reject any entry form that is submitted without proper payment or payment that does not constitute "good funds." No refunds will be made except under the following circumstances: any ticket order with payment received after (1) 50,000 Tickets have been sold, or (2) July 26, 2024, will be returned. No other refunds are available except in the exclusive discretion of Hope.

Upon receipt and acceptance by Hope of a proper entry, a receipt of purchase will be delivered to the purchaser via email at the email address provided by the purchaser during the Ticket purchase. It is the purchaser's responsibility to provide a valid, deliverable email address to Hope.

Any defective or physically altered entry form, or entry form received without proper or sufficient payment, will be immediately disqualified by Hope. Prior to the Grand Prize Drawing (described herein), Hope may make a reasonable effort to notify the individual of a rejected or disqualified entry by attempting to make contact through the information provided at the time of the Ticket purchase request. Neither Hope nor its directors, officers, employees, agents or other representatives assumes any responsibility or liability for lost, late, misdirected, mutilated, incomplete, illegible or undelivered entries, or any other failure to receive entries, or any failure to deliver a receipt of purchase prior to the drawing deadline.

Prize Drawings and Prizes

Prize drawings will be conducted by a representative of Hope under the supervision of an independent raffle auditor. All drawings are open to the public. Entrants need not be present to win. Winners will be selected at random. For each drawing, prizes with the lowest retail value will be drawn first progressing in order to the highest retail value prize for the drawing.

Grand Prize Drawing Date and Time: The Grand Prize Drawing will be held on August 9, 2024. To be eligible for this drawing, the entry must be received by 11:59 p.m. central time on July 26, 2024. (the "Final Ticket Purchase Deadline"). At the option of Hope, the drawing date for the Grand Prize may take place earlier if all Tickets have been sold prior to the July 26 deadline.

All orders for Tickets must be received and/or purchased by the indicated deadline to be eligible for the Grand Prize Drawing. Hope assumes no responsibility for lost, late, misdirected or non-delivered mail or fax messages, or any other failure to receive orders or deliver receipts prior to the drawing deadline.

Subject to availability and the terms and conditions of these Official Rules, prizes are as follows:

Grand Prize Drawing:

All vehicles come base model factory equipped and winner(s) are also solely responsible for any and all state or local license, title, registration, cost differential between the value of the car and the cash alternate prize, taxes, or fees associated with the vehicle, as well as insurance (proof of which must be shown prior to delivery) and pickup or delivery costs at the dealership as well as any non-standard options chosen by the winner and negotiated with the dealership. Hope makes no guarantee that the Grand Prize Winner will be able to sell the Dream Car for the value of the cash grand prize alternative, nor is there any guarantee that the Internal Revenue Service (IRS) will accept that value of the Dream Car for the purpose of determining any income tax that may be due from the Grand Prize Winner.

The Dream Car is based on manufacturer availability and may be substituted with a prize of similar value. The Dream Car comes base-model factory equipped. The Grand Prize Winner is solely responsible for any and all federal, state or local license, title, registration, taxes or fees associated with the vehicle as well as insurance (proof of which must be shown prior to delivery) and pickup or delivery costs at the dealership as well as any non-standard options chosen by the winner and negotiated with the dealership. The Dream Car is subject to availability at the automobile dealer selected by Hope and may be substituted for a comparable vehicle by Hope. The Dream Car, if awarded as a prize, will delivered F.O.B. Springfield, Illinois.

Vacation travel prizes are as described on the raffle website. Travel is transferrable. Travel must be used within 12 months of the Hope purchase date. Unless otherwise noted, all gratuities, taxes and fees are the responsibility of the winner and each vacation prize has a maximum value of no more than two thousand five hundred dollars in total. Winners of travel related prizes must comply with all applicable requirements and restrictions related to said prizes including without limitation applicable travel dates, age restrictions, liability waivers, travel documentation and reservation and confirmation procedures. All vacations are subject to availability and may be substituted with a comparable vacation prize or $1,000 cash.

50/50 Add-On Drawing

All Add-On Tickets must be ordered in conjunction with a main raffle ticket. Add-On ticket orders will not be accepted after the original raffle ticket order. Only one method of payment and only one mailing address are permitted. An individual can purchase as many Add-On tickets as he or she may wish. There is no limit on the maximum number of Add-On tickets that may be sold.

Notification of Winners

Winners will be notified according to the contact information provided to Hope at the time of Ticket purchase. If the Grand Prize Winner cannot be located by 5:00 p.m. on September 1, 2024, after reasonable attempts to make contact through the information provided at the time of purchasing the Ticket, such winner will be deemed to have elected the onetime cash alternate prize and another winner will not be selected for such prize. If a selected winner is unable to be contacted or located after a period of four (4) months from the draw date of the applicable raffle drawing, the prize or its cash equivalent will be deemed to have been donated to Hope.

In order to collect a prize, a winner must sign and deliver to Hope: (a) a sworn affidavit of eligibility in accordance with these Official Rules and applicable law, including, without limitation, proof of age; (b) such written information as is required by any applicable tax laws, including, without limitation, his/her Social Security Number; and (c) proof of identity in forms satisfactory to the Hope showing that the person claiming the prize is the same person who is named on the winning Ticket. Winners of prices of $1,000 or more will be required to submit Form W-9, Form IL-5754 Statement by Person Receiving Gambling Winnings, and Form W-2G Certain Gambling Winnings (provided by Hope) for tax withholding purposes.

A list of winners will be posted on the Raffle website within one week of the applicable drawing. A copy of the winners' list and of these Official Rules may be obtained by sending a self-addressed, stamped envelope to: The Hope Raffle, 15 East Hazel Dell Lane, Springfield, IL 62712. Requests must be received within 30 days of the close of the Raffle.

Non-Deductibility of Ticket Purchase

The IRS has taken the position that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts, and consequently, the purchase of a Ticket does not qualify as a deductible charitable contribution.

Taxes

There may be federal, state and/or local tax consequences of winning a prize in this Raffle. Any and all taxes are the sole responsibility of the winner. Each purchaser of Tickets is advised to consult his or her own tax advisors with respect to tax liabilities that may arise from winning a prize in this Raffle. Winners of prizes of $1,000 or more may be required to submit a W-2G, Form 5754 or similar tax form (provided by Hope) for tax withholding purposes. All appropriate and required federal and state taxes will be withheld by Hope in accordance with federal and state law, and Hope will remit the balance of the cash prizes to the winners.

Terms and Conditions

The Raffle is subject to these Official Rules. These Official Rules cannot be changed by any oral statement made by any employee, consultant or agent acting on behalf of Hope. By entering this Raffle, entrants accept and agree: (1) to be bound by these Official Rules and the decisions of Hope which shall be final and binding; (2) waive any right to claim ambiguity in the Raffle or these Official Rules; and (3) that Hope may use the entrant's name, photograph, likeness, statements, biographical information, voice and city and state address for promotional or advertising purposes in connection with the Raffle on a worldwide basis and in all forms of media, now or hereafter known, in perpetuity, without review, permission or further compensation, except where prohibited by law. Other rules and regulations may apply. Please contact Hope if you have any questions. This Raffle is void where prohibited by law.

BY ENTERING THIS RAFFLE, EACH ENTRANT RELEASES Hope, ITS DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS FROM ANY AND ALL LIABILITY FOR INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, ATTORNEY'S FEES) CAUSED BY PARTICIPATING IN THE RAFFLE OR WINNING ANY PRIZE OR RESULTING FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE, AND EACH WINNER AGREES TO INDEMNIFY AND HOLD HOPE HARMLESS FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS AND ACTIONS OF ANY KIND ARISING FROM, IN CONNECTION WITH, OR AS A RESULT OF PARTICIPATING IN THE RAFFLE OR THE WINNER'S ACCEPTANCE OR USE OF ANY PRIZE.

A RAFFLE ENTRANT'S SOLE AND EXCLUSIVE REMEDY FOR ANY CLAIM AGAINST HOPE ARISING OUT OF THE SALE OF TICKETS OR THE CONDUCT OF THE RAFFLE SHALL BE LIMITED TO THE RETURN OF THE PURCHASE PRICE PAID FOR HIS OR HER TICKET(S). IN NO EVENT SHALL HOPE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR REPRESENTATIVES BE LIABLE TO ANY PARTY FOR ANY LOSS OR INJURIES TO EARNINGS, PROFITS OR GOODWILL, OR FOR ANY INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY PERSON OR ENTITY WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THE RAFFLE OR THESE OFFICIAL RULES SHALL BE SETTLED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (PURSUANT TO ITS EXPEDITED PROCEDURES) UNDER ITS COMMERCIAL ARBITRATION RULES AND CONDUCTED IN SPRINGFIELD, ILLINOIS, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF.

Cancellation/Termination of Raffle

By purchasing a Ticket and choosing to participate in the Raffle, each Raffle participant acknowledges and agrees that Hope has the right, in its sole discretion, to elect not to proceed with the Raffle for any reason whatsoever or for no reason, and in such event, a participant's sole and exclusive remedy shall be to receive a refund of the full price paid by such participant for each Ticket purchased, without interest.

Registration with the State of Illinois

Hope has registered with the Sangamon County Clerk's Office under Raffle License Number 2024-00138. The Raffle License Number will be published in all marketing materials where possible.
